ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.11.2025 for the alleged offences punishable under Sections 366, 344, 376(3) of IPC and Sections 5(1) r/w 6, 16, 17 of POCSO Act, 2012 and Sections 9 and 10 of Prohibition of Child Marriage Act, 2006 in Crime No.6 of 2023, registered on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner was earlier arrested and released on bail for offences punishable under Sections 366, 344, 376(3) of IPC and Sections 5(1) r/w 6, 16, 17 of POCSO Act, 2012 and Sections 9 and 10 of Prohibition of Child Marriage Act, 2006 and he was earlier appeared regularly and later absconded on 31.12.2024 and NBW was issued against the petitioner and the same was executed on 20.11.2025.

3. Earlier, this Court dismissed the bail petition in Crl.OP.No.3442 of 2026 dated 09.01.2026 on the following reasons: "6. Considering the submissions made on either side and that the petitioner has absconded for nearly one year and the victim herself is delaying the trial which is of the year 2023 and the trial is now going on and hence this Court is not inclined to grant bail to the petitioner at this stage."

4. Since there is no change in circumstances to revisit the earlier order, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 12.02.2026 drl 2/4
