..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondent to waive the deposit of Rs.10 Lakhs (Rupees Ten Lakhs), a condition issued to the nursing college to pay towards improvement of the facility of the concerned primary health Centre to the concerned District Health Society, every year and this may be enforced as a one-time measure, when the nursing college is established. ORDER
The petitioner has approached this Court directing the respondent to waive the deposit of Rs.10 Lakhs (Rupees Ten Lakhs) to the concerned District Health Society, every year.
2.When the matter was taken up for hearing today, the learned Additional Government Pleader submitted a clarification letter issued by the Director of Public Health and Preventive Medicine, which reads as follows: "4.In G.O.Ms.No.84 Health and Family Welfare (N1) Dept., dt 02.04.2025, Government have issued an amendment to (4)(a)(ii) of G.O.Ms.No.44, Health and Family Welfare (N1) Department, dated 20.02.2017 as follows:
"To deposit a sum of Rs.10 Lakhs (Ten Lakhs only) towards improvement of the facility of the concerned primary health Centre to the concerned District Health Society and the expenditure shall be authorised by the District Collector concerned."
5.In this office R.No.7509487/Trgl/S2/2024 dated 16.04.2025, all District Health Officers are instructed to communicate the above amendment G.O. to all the Private Institutions in their Districts and also instructed to adhere the above instructions. The Deposit amount of Rs.10 Lakhs is one time and not every year as stated by the petitioner." Recording the same, this writ petition stands disposed of.
