Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 1st respondent to consider petitioner's representation dated 06/11/ 2024 and consequently pass necessary order in the Encumbrance Certificate reversing the entry in the respect of the document bearing a registration number DOc. No.1281 of 1985 before the Panapakkam SRO and Vide Doc. No. 5427/ 2007 4176 / 2017, 1240/ 2018 before the Kaveripakkam SRO as per the order issued by the Hon'ble High Court in W.P. (Md) No. 10177 of 2021 dated 17.06.2021.

O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the 1st respondent to consider the representation made by the petitioner on 06.11.2024, wherein the petitioner is seeking for the cancellation of the entries that were made when the documents were registered in the year 1985 and also the subsequent registration.

2.Heard Mr.M.Silambarasan, learned counsel for the petitioner and Mr.B.Vijay, learned Additional Government Pleader for R1 to R5. 3.In the considered view of this Court, the official respondents cannot cancel or reverse any entry made in the encumbrance certificate since it will tantamount to 2 / 4

canceling the documents itself. The registration authority does not have the power to cancel any registered documents. Hence, if the petitioner is aggrieved by the documents executed and registered, the petitioner has to workout his remedy before the competent Civil Court. Except giving this clarification, no further orders can be passed in this writ petition.
