Crl.O.P.No.4390 of 2022 Dr.G.JAYACHANDRAN. J, Due to recklessness and negligence of not closing the Bore-well, two kids aged four years and three years, have fallen into the bore well and lost their life.

2. The petitioner herein would state that they have taken due care to close the bore-well but the children without proper supervision were played near the place of the bore-well, which has led to the accident.

3.This Court finds in spite of repeated incidents widely reported, the persons who are in charge of digging bore-well of high magnitude, failed to take proper precaution, which hardly requires a few hundred rupees. The prosecution is under way of collecting evidence to rule out the innocence of the petitioner.

4.Taking note of the fact that petitioner is the owner of the land and he is responsible for taking due caution, this Court is not inclined to grant bail to the petitioner at this juncture. Hence, this petition for bail is dismissed.
