O R D E R
This Civil Revision Petition has been filed seeking a direction to the I Additional Family Court, Chennai to dispose of H.M.O.P.No.1565 of 2011 on the file of the I Additional Family Court, Chennai within a period of three months from the date of disposal of this Revision Petition.
2. The petitioner is the husband and respondent is the wife. The petitioner filed H.M.O.P.No.1565 of 2011 on the file of the I Additional Family Court, Chennai against the respondent on the ground of cruelty and desertion. In the said petition, the respondent filed counter statement and due to her non-appearance, she was set exparte on two occasions. Subsequently, on filing the petition by the respondent, the exparte order was set aside. Though the petitioner was examined as P.W.1 on 28.6.2013, the respondent did not cross examine the petitioner and the HMOP is pending without any progress. Now, the present Civil Revision Petition is filed for the speedy disposal of H.M.O.P.No.1565 of 2011.
3. Heard the learned counsel appearing for the petitioner and perused the materials available on record.
4. Having regard to the submissions made by the learned counsel for the petitioner, considering the limited prayer sought for in the Civil Revision Petition and since the H.M.O.P. is pending from 2011, without expressing any opinion with regard to the merits of the matter, I direct the learned I Additional Family Court Judge,
Chennai to dispose of the H.M.O.P.No.1565 of 2011 on merits and in accordance with law as expeditiously as possible, in any event, not later than three months from the date of receipt of a copy of this order.
5. The Civil Revision Petition is disposed of with the above direction. No costs.
