ORDER

This Criminal Original Petition has been filed for direction directing the respondent police to set aside the closure intimation dated 28.11.2024 and re-investigate the complaint dated 14.10.2024 lodged by this petitioner and take action on the complaint given by the petitioner within a stipulated time fixed by this Hon'ble Court.

2. It is seen that the petitioner lodged a complaint before the second respondent and the same was enquired and closed by the second respondent. Admittedly, no FIR has been registered on the file of the second respondent and as such, the second respondent need not file a closure report before the jurisdiction Court. On the complaint lodged by the petitioner, detailed enquiry was conducted and closed the same.

3. Therefore, the petitioner has an option to file a private complaint in the manner known to law. When it being so, this Court cannot entertain this petition challenging the closure report filed by the second respondent that too without registering FIR, the complaint was closed.

4. In view of the above, this Court finds no merits in this petition. Accordingly, this Criminal Original Petition is dismissed. 10.02.2025 Internet:Yes Index:Yes/No Speaking/Non speaking order mn
