Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd Respondent police to provide police protection to the petitioner, his company and the other employees of the company M/s Trivenimudrai project Limited's project VSP NH - 45 plant, the road constructed so far and also for the forthcoming constructions for NH-45 as sought for in the petitioner's representation dated 24.01.2023 sent to the Respondents 1 to 3, as there is a potential threat for the petitioner and other employees' life and the construction works carried out by the petitioner's company. O R D E R
This writ petition has been filed for a direction to the respondent Police to provide police protection to the petitioner in order to enable the petitioner to proceed further with the constructions for NH-45 based on the complaint given by the petitioner on 24.01.2023.
2.The learned Government Advocate (Crl.Side) on instructions submitted that enquiry is pending based on the complaint given by the petitioner on 24.1.2023.The learned Government Advocate (Crl.Side) further submitted that the petitioner can be directed to give a fresh representation to the respondent police.
3.There shall be a direction to the petitioner to give a fresh representation/complaint to the respondent police. On receipt of the same, the 3rd respondent shall call the parties and make an enquiry 3.The petitioners are directed to co-operate with the Police for enquiry and the respondent Police shall conduct the enquiry keeping in mind the judgment in Lalitha Kumari vs. Government of Uttar Pradesh reported in 2013 (6) CTC 353. On completion of the enquiry, the respondent Police shall take a decision regarding the further course of action. This process shall be completed by the respondent Police within a period of four weeks from the date of receipt of copy of this order.
