CMP.Nos.2614, 2615, 2619, 2621, 2623 & 2626 of 2022 in AS Nos.266, 264, 263, 262, 248 & 245 of 2020 C.V.KARTHIKEYAN, J.

These applications have been filed to set aside the judgment and decree dated 14.02.2020 in the respective First Appeals and to re-hear the First Appeals on merits.

2.In the affidavit filed in support of the petitions, it had been stated that when the First Appeals came up for hearing on 14.02.2020, the present petitioners were not represented and it is also stated that without directing notice, the Appeals were partly allowed and the present petitioners / respondents were also set exparte.

3. Heard the learned Government Pleader on behalf of the respondents.

4. My attention is drawn to two similar orders passed by two learned Single Judge of this Court in connected Civil Miscellaneous Petitions and connected First Appeals dated 08.09.2021 and 21.12.2021 and who had allowed the similarly filed Civil Miscellaneous Petitions and had restored the First Appeals to file.

smv 5.In order to maintain consistency, it would only be appropriate and also prudent and this Court also does the same and therefore, the present Civil Miscellaneous Petitions are allowed and the respective First Appeals are restored to filed.
