Respondent(s) PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 1st respondent to dispose of petitioner's Application No.20250726038452 and Application No.20250726038876 dated 26/07/2025 to survey the land in the Thimmanaickenpatti Survey No.12/5, 12/8, 43/5, 43/5, 43/8, 44/1 and 43/7 an extent of property over 0-14.00, 0-8.00, 0-5.50 and 0-11.00 Ares respectively in Rasipuram Taluk, Namakkal District and mark the Boundaries based on the meats and bounds for fencing the agriculture land along with the necessary and appropriate police protection.

ORDER

This writ petition has been filed seeking for a direction to the 1st respondent to survey and demarcate the property, which according to the petitioner is owned by him, based on his applications dated 26.07.2025 within a time frame to be fixed by this Court.

2.The petitioner had submitted the applications on 26.07.2025 for the aforesaid purpose. Since the same have not been considered till date, the petitioner has filed this writ petition.

3.Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the 1st respondent. Mr.Venkatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the 2nd respondent. 4.No prejudice will be caused to the 1st respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property, more fully described in the prayer to this writ petition, after hearing the

objections if any from the neighbouring land owners as well as any other party as they deem fit. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the 1st respondent is directed to issue notice to the neighbouring land owners and also to any other party, if they deem fit to put on notice.

(b) After receiving objections if any and after considering the same, the 1st respondent shall conduct survey and demarcate the boundaries of the property, more fully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

(c) If the need arises for police assistance, on a request made by the 1st respondent, the 2nd respondent shall render police assistance for the effective implementation of this order.
