This Criminal Original Petition has been filed by the petitioner, who Page No.1 of 4
was arrested and remanded to judicial custody on 24.11.2024, seeking bail in Crime No.828 of 2024 registered for the offence under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985. 2.
The case of the prosecution is that the petitioner along with other accused were found in possession of 21.900 kilograms of Ganja. 3.
The learned counsel for the petitioner would submit that the petitioner that considering the period of incarceration, the petitioner may be released on bail. He also filed additional grounds stating that the contraband seized was not produced before the learned Trial Court Judge immediately.

Learned Government Advocate (Crl.Side) appearing for the respondent police, reiterated the prosecution case and on instructions submitted that the contraband seized was produced before the learned Trial Court Judge on 25.11.2024 and hence there was no delay. Page No.2 of 4

Considering the aforesaid facts and since the contraband seized was a commercial quantity and the petitioner has not satisfied the twin conditions stipulated under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner at this stage and accordingly, this criminal original petition is dismissed.
