This petition is filed seeking to set aside the order of dismissal of appeal C.M.A.No.3167 of 2007 on 17.12.2018 for default and restore the appeal on file and dispose on merits.

2.Heard the learned counsel for the petitioner/appellant.

3.The learned counsel for the respondents 1 to 3 has no objection for the order, dated 17.12.2018 being set aside and the appeal being restored to file.

4.Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and C.M.A.No.3167 of 2007 is restored to file.
