PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the 1st respondent in proceedings Na.Ka.No.4831/N1PA-2/2011 dated 12.05.2011 and quash the same, consequently direct the 1st respondent to pass necessary orders regularizing the service of the petitioner in a suitable post in accordance to law, with all monetary and service benefits.

ORDER

The Writ Petition is filed calling for the records of the 1st respondent in proceedings Na.Ka.No.4831/N1PA-2/2011 dated 12.05.2011 and quash the same and consequently direct the 1st respondent to pass necessary orders regularizing the service of the petitioner in a suitable post in accordance to law, with all monetary and service benefits.

2.Petitioner was not present on 19.02.2024 and 26.02.2024. Therefore, this matter was adjourned today, under the caption "for dismissal". Today also, there is no representation for the petitioner. 3.It is the submission of the learned counsel for the 1st respondent that Government of Tamil Nadu has issued G.O.Ms.No.22, Personnel and Administrative Reforms (F) Department, dated 28.02.2006, wherein it is stated that, "2.Based on the announcement made by the Hon'ble Chief Minister on 8.2.2006, the Government direct that the services of the daily wages employees working in all Government Departments who have rendered 10 years of service as on 1.1.2006 be regularised by appointing them in 2/5

the time scale of pay of the post in accordance with the service conditions prescribed for the post concerned, subject to their being otherwise qualified for the post." 4.As per the qualification required for Electrician, one must possess the following conditions, (i) A pass in SSLC examination (ii) Must possess a National Trade Certificate in Electrician issued by NCVT, New Delhi (iii) Must possess "B" certificate issued by the Electrical Licensing Board, Chennai.

(iv) Must have a minimum experience of five years of electrician in any reputed company or Govt. Undertaking. However, petitioner had possessed the qualification of, (i) Passing of SSLC (ii) Competency examination passed in Cinema Operator in June, 1993. 5.Except passing SSLC, petitioner did not posses other three qualifications for regularizing his service as Electrician and therefore, his service was not regularized.

6.Considering the fact that petitioner is absent on two occasions and 3/5

there is no representation for the petitioner even today and considering the submissions of the learned counsel for the 1st respondent, this Writ Petition is dismissed as it has no merits and for non-prosecution.
