The present petition has been filed to modify one of the condition imposed on the petitioners in Paragraph No.9 of the order dated 09.01.2023 passed by this Court in Crl.O.P.No.21753 of 2023 while granting anticipatory bail.
2. The learned counsel for the petitioner would submit that one of the conditions imposed on the petitioners is that " the first petitioner was directed to deposit a sum of Rs.25,00,000/- to the credit of Cr.No.10 of 2021 and the second petitioner was directed to deposit title deeds worth to the tune of Rs.25,00,000/- standing either in his name or in the name of the family members/relatives/friends of the petitioners, along with the valuation certificate obtained from the concerned Revenue authorities within a period of 15 days. He would further submit that due to financial crisis, first petitioner is unable to mobilize such a huge amount. He would further submit that A1 and A2 jointly would be able to deposit title deeds worth to the tune of Rs.50,00,000/- standing in their name or in the name of their 1/3
family members/relatives/friends. Hence, he would seek to modify the aforesaid condition.
3. By way of reply, the learned counsel for the petitioner would raise objection by stating that this after getting instructions from the petitioners, the said condition was imposed. Now, contrary made before this by the petitioners for complying with the aforesaid conditions.
4. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.
5. Taking into consideration, the facts and the submissions made by the both counsel, after getting instructions from the petitioners, the said condition was imposed, at this juncture, the petition to modify the said condition is not maintainable.
6. Accordingly, this Criminal Miscellaneous Petition is dismissed..
