O R D E R

The petitioner seeks for a Mandamus forbearing the respondents herein from in any manner interfering with the running of the Ayurvedic Clinic under the name and style of "New Tulip Ayurvedic SPA"at Sangamam Tourist Home, No.1/6, K.N.P. Complex, Eswaran Kovil Street, Tiruppur.

2. Heard both sides.

3. It is stated by the learned Government Advocate that the petitioner is running SPA without getting license from the competent authority.

4. The very same issue was already considered by this Court in a batch of cases in W.P.No.31914/2018 etc. dated 04.04.2019 by passing an order imposing certain terms and conditions therein. Though time was granted for the petitioner like persons to apply for license by extending the time to apply for the same till 30.06.2019, the petitioner seems to have not applied so far. Therefore, it is for the petitioner to apply before the concerned authority for grant of license and only after getting such license, the petitioner can run the Ayurvedic Spa.

Accordingly, the Writ Petition is disposed of by permitting the petitioner to apply for such license before the competent authority within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application, the competent authority shall pass orders on the said application on merits and in accordance with law within a period of four weeks thereafter. Till an order is passed by the competent authority, the petitioner shall not run the Ayurvedic Spa. No costs. Consequently, connected miscellaneous petition is closed.
