CMP.No.5250 of 2022 and CMP.No.15301 of 2025 in S.A.No.970 of 2010 C.V.KARTHIKEYAN, J.

The petition in CMP.No.5250 of 2022 has been filed consequent to the death of the third respondent and to bring on record his legal heirs viz., P.Muthayee and P.Periyasami as respondents 4 and 5. Notice had been directed to the respondents and Mr.Babu Rangasamy, learned counsel, states that he would enter appearance on behalf of the fifth respondent P.Periyasami.

2. Mr.M.R.Jothimanian, learned counsel for the first respondent stated that the second respondent who is the husband of the first respondent, had also died. Therefore, CMP.No.15301 of 2025 had been filed to bring on record the legal heirs of the second respondent as respondents 6 and 7. The learned counsel for the first respondent states that he would enter appearance on behalf of the proposed respondents 6 & 7. Therefore, notice need not be directed to the said respondents.

3. In view of the above circumstances, these Civil Miscellaneous Petitions are allowed.

4. The Registry may examine whether the vakalat has been filed on behalf of the proposed respondents. The Registry to carryout the necessary https://www.mhc.tn.gov.in/judis

gsk amendment in the cause title of the Second Appeal indicating the death of the third respondent and bring on record his legal heirs as 4th and 5th respondents. The Registry may also note that the second respondent had also died and that his legal heirs may be brought on record as respondents 6 and 7.
