PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the second respondent not to harass the petitioner under the guise of enquiry except due process of law. For Petitioner :Mr. M.Kannan For Respondents:Mr.M.Mohamed Riyaz, Additional Public Prosecutor

O R D E R

This petition has been filed to direct the second respondent not to harass the petitioner under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The learned counsel for the petitioner has submitted that the second respondent without issuing any notice has compelled the petitioner to furnish bond under Section 110 of Cr.P.C and therefore, he requests to direct the second respondent not to harass the petitioner.

4. Per contra, the learned Additional Public Prosecutor has submitted that since the proceedings have been initiated under https://hcservices.ecourts.gov.in/hcservices/

Section 110 of Cr.P.C, the petitioner has to challenge the said proceedings and instead of that, he cannot file this kind of petition and therefore he prayed to dismiss this petition.

5. If the petitioner was called to furnish bond under Section 110 of Cr.P.C, the petitioner has to challenge the said proceedings and instead of that, he cannot file a petition stating that the second respondent is harassing him. Hence, this Court does not find any merit in this petition.

6. For the aforesaid reasons, this Criminal Original Petition is dismissed.
