ORDER
The Revision Petitioners herein are the plaintiffs, who filed the suit in O.S.No.429 of 2022 on the file of I Additional Sub Court, Salem against the defendants 1 to 7 for the relief of declaration and permanent injunction.
2. Since the relief claimed by the Revision Petitioners is only seeking a direction for a speedy disposal, the notice to the respondents is dispensed with.
3. The learned counsel for Revision Petitioners would submit that the 1st respondent, who is aged abut 75 years and the suit was filed in the year of 2022. But, so far, the trial was not begin and there is no progress in the trial. Therefore, he wanted to direct the trial court to dispose the case as early as possible.
4. Considering the facts and circumstances and also the fact that the 1st respondent is aged about 75 years old senior citizen and the suit is pending from the year of 2022, but as on date, issues not framed and so far there is no progress in the trial, this Court is inclined to direct the trial judge to commence the trial and dispose the case as expeditiously as possible within a period of five months from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of. No costs.
