Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing the third respondent to consider the representation dated 23.12.2020 by the petitioner within a reasonable time.

(The case has been heard through video conference) The writ petition has been filed seeking a direction to the third respondent to consider the petitioner's representation to cancel the sale deed executed by the fourth respondent.

2. According to the petitioner, earlier the petitioner executed a power of attorney in favour of the fourth respondent for alienating his properties. Thereafter, he cancelled the power of attorney but fraudulently the fourth respondent executed various sale deeds. Hence the petitioner made a representation to the second respondent District Registrar to https://hcservices.ecourts.gov.in/hcservices/

conduct enquiry and to take suitable action against the fourth respondent and that application has not been considered, hence the present writ petition has been filed.

3. Mr.Yogesh Kannadasan, learned Government Advocate appearing for the respondents 1 to 3, on instructions from the second respondent, submitted that considering the petitioner's representation an enquiry has been initiated by the second respondent and notice has been issued on five occasions to the petitioner and the fourth respondent and the last one being 16.07.2021. He further submitted that the second respondent may be directed to proceed with the enquiry and pass orders.

4. Considering the fact that enquiry has already been commenced by the second respondent District Registrar, he is directed to proceed with the said enquiry and after hearing the petitioner and the fourth respondent pass suitable orders within a period of twelve weeks from the date of receipt of a copy of this order. This writ petition is disposed of accordingly. Consequently, the connected miscellaneous petition is closed. No costs.
