Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Declaration, 1/4

declaring the action of the respondents in altering the educational qualification for the Tamil Nadu Boiler Attendants Examination - 2010 for the First Class, Second Class and Third Class Boiler Attendants Certificate of Competency contrary to the initial Notification appended to the application, prescribing higher qualification and denying appearance for the examination to the candidates not having new qualification prescribed as illegal, arbitrary and contrary to law and consequently direct the respondents to conduct examination by permitting all the candidates who have the required qualification as per the instructions appended to the application form for the Tamil Nadu Boilers Attendants Examination - 2010 and pass such further orders.

This writ petition is filed for issuance of a Writ of Declaration, declaring the respondents in alteration of educational qualifications for the Tamil Nadu Boiler Attendants Examination - 2010 and consequently directing the respondents to allow all candidates with the required qualifications to appear as per the instructions appended to the application form for the Tamil Nadu Boilers Attendants Examination - 2010. 2/4

2. Learned counsel for the petitioner submitted that the time has lapsed in this writ petition since the Tamil Nadu Boilers Attendants Examination is of the year 2010.

3. Due to the effect of time lapse, nothing survives in this writ petition for further adjudication and the petitioner may be given liberty to raise a question of law in the future if any arise.
