No.6A and to promote him as Assistant Executive Engineer from 28.07.2023 with all service and monetary benefits since the said Charges initiated by the Director of Municipal Administration in Na.Ka.NO.27967/2022/C3-2 dated 06.02.2025 had been "dropped" in G.O. (2D) No.03, MAWS Department dated 06.02.2025 in accordance with the provisions under Schedule XI of the Tamil Nadu Government Servants 1/4
(Conditions of Service) Act. 2016 within a reasonable period as may be fixed by this Honble Court.

ORDER
Dr.T. Seenivasan, learned counsel takes notice for respondents. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner was initially appointed as Assistant Engineer on 29.06.2007 and had served in various Municipalities and Town Panchayats under the control of the Directorate of Municipal Administration. He attained the age of superannuation on 31.05.2025 and was permitted to retire.
3. It is the case of the petitioner that though his name was included in the zone of consideration at Sl.No.17 in the panel for promotion to the post of Assistant Executive Engineer for the year 2022-2023, he was not considered on account of a charge memo dated 03.11.2022. According to the petitioner, on the crucial date, namely 15.03.2022, no charge memo was pending. It is the further contention that the charges were subsequently dropped in G.O.(2D) No.03, MAWS Department dated 06.02.2025. Thereafter, the petitioner made representations seeking retrospective promotion from 28.07.2023, the date on 2/4
which his junior was promoted in G.O.(D) No.484, MAWS Department dated 28.07.2023, and for inclusion of his name in the panel published in G.O.(D) No.434, MAWS Department dated 28.07.2023. Since no orders have been passed on his representations, the present writ petition has been filed.
4. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents.

Without expressing any opinion on the merits of the claim, this Court directs the 1st respondent to consider the petitioner's representations, and pass appropriate orders on merits and in accordance with law, including the claim for retrospective promotion and attendant benefits, within a period of six weeks from the date of receipt of a copy of this order.
6. With the above directions, this writ petition stands disposed of. No costs.
