Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 380 of IPC in Cr.No.26 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The petitioner herein is arrayed as A2 in the case of theft of iron rod worth about Rs.24000/-. Hence, the complaint.
3. As per the submission made by the learned Government Advocate (Crl.Side), 25 number of iron rods worth about Rs.24000/- was removed from the terrace of the defacto complainant by four accused and on complaint, only 9 rods were recovered from the accused Nos.1, 3 and 4 and they were arrested by the respondent police.
4. This petitioner who is an auto driver in whose vehicle the iron rods were transported is at large and the remaining 16 rods yet to be recovered. The auto of this petitioner has been recovered. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of the case, the petitioner herein is still at large and a substantial portion of the property (iron rod) is yet to be recovered, this Court finds that it is not a fit case for granting anticipatory bail to the petitioner.
