Mr.K. Raja COMMON ORDER These Writ Petitions have been filed seeking a direction to the respondent(s) to pay interest at the rate of 6 percent per annum for the belated payment viz., Gratuity, Provident fund, EL Salary and Pension Commutation respectively from the date of retirement to the date of actual payment to the petitioners, within a time limit as fixed by this Court.
2. It is the case of the petitioners that they joined the service of the respondent Corporation during the year 1987 to 1997 and had retired from service on 30.06.2024 & 31.05.2024 respectively. However, the Gratuity, Provident fund, EL Salary and Pension Commutation respectively were paid belatedly. Therefore, the petitioners claimed interest on the belated settlement of retirement benefits as well as claiming eligibility under the 12(3) Settlement Arrears etc., and they had also made a representation on 08.12.2025 and 09.12.2025 respectively, which has not evoked any response so far. Hence, the present Writ Petitions.

3. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petitions are taken up for hearing at the admission stage itself.

In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to consider the petitioner's representations, and to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits as stated supra from the date of retirement till the date of actual disbursal of the retirement benefits of the petitioner, if there is no impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.
