This petition has been filed to quash the FIR in Cr.No.16 of 2015 on the file of the 1st respondent .

2.Heard the learned counsel for the petitioner.

3. It is seen that one Krishnaveni lodged a complaint to the police alleging that the petitioner herein came on 04.04.2015 around at 10.00 in the night, threatening to hand over the vacant possession of the property, which is alleged to be illegally occupied. It is also alleged in the FIR that Alli/1st petitioner had assaulted her by hands and the other two petitioners abused her in filthy language.

4. Mr.A.Sirajudeen, learned counsel for the petitioner submits that apart from the allegations, there are no other allegations in the F.I.R.

5. It is seen that all the three persons were together and prima facie have shown common intention and the FIR could be quashed only within the parameters laid down by the Hon'ble

Supreme Court in State of Haryana Vs Bhajan Lal reported in 1992 Supp [1] SCC 335. Hence, this Court is not inclined to quash the FIR.

6. Now the learned counsel for the petitioner also submitted that the signature of Krishnaveni has been forcibly obtained by the police. In exercising jurisdiction under Section 482 of Cr.P.C., this Court would not embark upon an enquiry on disputed question of facts.

7. With the above observation, this petition is closed. Consequently, connected Miscellaneous Petition is closed. 03.06.2015 kkd Index : Yes/No Internet : Yes/No
