O R D E R

The petitioners have filed the above Writ Petition to issue a writ of mandamus to direct the 2nd respondent to dispose of the joint representation dated 17.10.2012 giving by the petitioners to the 2nd respondent seeking cancellation of the patta in Patta No.235 issued by the 2nd respondent pertaining to the property

situated at No.51, Puduchery Village, Madurantakam Taluk, Kancheepuram District comprised in Survey No.39, 40/2 admeasuring to an extent of 12 acres and 38 acres respectively. 2.The learned counsel appearing for the petitioners submitted that challenging the issuance of patta, the petitioners filed an appeal before the 2nd respondent on 17.10.2012, however the 2nd respondent has not disposed of the same yet.

3.Mr.K.Govi Ganesan, learned counsel for the respondents 4 & 5 submitted that the 2nd respondent may be directed to dispose of the appeal within a time frame, after giving notice to the respondents 4 and 5.

4.Ms.A.Madhumathi, learned Special Government Pleader appearing for the respondents 1 to 3 submitted that the 2nd respondent may be directed to dispose of the appeal within a time frame.

5.Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for in the Writ Petition, without expressing any opinion with regard to the merits of the case, I direct the 2nd respondent to dispose of the appeal filed by the petitioners on 17.10.2012 and pass orders, on merits and in accordance with law, after giving notice to the respondents 4 and 5, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6.With these observations, the Writ Petition is disposed of. No costs.
