PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the condition of order made in the above Crl.O.P.No.826 of 2025 dated 10.01.2025 as the appearance of the petitioner before the learned Judicial Magistrate, Srikali, Mayiladuthurai District instead of the learned Principal Sessions Judge, Villupuram. ORDER
The petitioner seeks modification of the condition directing the petitioner to appear before the learned Principal Sessions Judge, Villupuram, on all working days at 10.30 a.m., until further orders imposed by this Court in Crl.O.P.NO.826 of 2025 dated 10.01.2025.
2. The learned Government Advocate (Crl.Side) on instruction, submitted that the petitioner has been complying with the condition regularly imposed by this Court vide its order dated 10.01.2025 in Crl.O.P.No.826 of 2025.
3. In view of the same, the condition imposed on the petitioner in para no. 4(b) in Crl.O.P.No.826 of 2025 dated 10.01.2025 is modified, directing the petitioner to appear before the learned Principal Sessions Judge, Villupuram, on all hearing dates. The other conditions imposed in the order dated 10.01.2025 in Crl.O.P.No.826 of 2025 shall remain unaltered. Page No.2 of 4
4. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.
5. Accordingly, the criminal miscellaneous petition is ordered, and the condition is modified.
