ORDER : The Court Made the following order :- The petitioner apprehend arrest at the hands of the respondent police for the alleged offences under Section 498 (A) IPC and seeks anticipatory bail.
2.The learned counsel for the petitioner submitted that due to the crept of misunderstanding between the couple, the petitioner has filed HMOP.No.88/2010 for divorce and subsequently, on the advice of the elders, he withdrew the same. Even after withdrawal of the petition, his wife did not turn up and also had wordy quarrel with her mother-in-law in respect of partition.
3.Learned Government Advocate (Crl.Side) submitted that it is only a matrimonial dispute and the petition enquiry is going on. He has no serious objection.
4.Considering the facts and circumstances of the case and taking note of the fact that the case pertains to matrimonial dispute, and there is no need for custodial interrogation at this stage, this Court is inclined to grant the relief of anticipatory bail to the petitioner.
5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the
date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Metropolitan Magistrate, XVII, Saidapet, Chennai, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation. -sd/- 08/03/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
