(CRIME NO.14 OF 2020) Petition praying that in the circumstances stated therein the High Court will be pleased to modify the conditions in Crl.OP.No.15035 of 2020 in order dated 24.09.2020 and permit the Petitioner to surrender before Judicial Mgistrate, Tiruchengode instead of Judicial Magistrate, Namakkal in Crime No.14 of 2020 on the file of District Crime Branch, Namakkal.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.A.L.GANDHIMATHI, Advocate for the petitioner and of MR.T.SHUNMUGARAJESWARAN Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous petition is filed by the petitioner, seeking to modify the condition in Crl.O.P.No.15035 of 2020, vide order dated 24.09.2020, permit the petitioner to surrender before the Judicial Magistrate, Tiruchengode instead of Judicial Magistrate, Namakkal, in Crime No.14 of 2020, on the file of the District Crime Branch, Namakkal.
2.The learned counsel for the petitioner would submit that though the case has been registered by the District Crime Branch, Namakkal Police Station, the FIR is now pending on the file of the learned Judicial Magistrate, Tiruchengode. Whereas at the time of filing of the Criminal Original Petition in Crl.O.P.No.15035 of 2020, the petitioner has mentioned the satisfaction Court as Judicial Magistrate, Namakkal instead of Judicial Magistrate, Tiruchengode. Hence, he seeks for modification. 3.Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

4.Considering the above facts and circumstances of the case, the petition is ordered and the satisfaction Court mentioned in Crl.O.P.No.15035 of 2020, vide order dated 24.09.2020, is modified that the petitioner shall surrender before the learned Judicial magistrate, Tiruchengode, instead of the learned Judicial Magistrate, Namakkal.
