O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(b) of BNS and Section 21(1) of Mines & Minerals Act in Crime No.422 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of one unit of river sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

Considering the fact that huge quantity of the river sand has been transported by the petitioner and cause damage to river bed and ecology and if the petitioner is granted anticipatory bail, he would indulge in similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.
