2.The applicant herein is the plaintiff in C.S.No.187 of 2016. He has filed this application under Order XIV Rule 8 of the Original Side Rules read with Order VII Rule 14(3) of C.P.C. praying to condone the delay in filing the documents.

3.Though the learned counsel appearing for the respondent/defendant objecting to allow this application, considering the fact that this application is filed only to condone the delay in filing the documents, the objection raised by the respondent/defendant cannot be sustained, in otherwise, if the respondent/defendant is having objection in respect to the documents which enclosed along with the application, he is having liberty to raise his objection only at the time of marking those documents as exhibits before the learned Master. Otherwise, objecting for receiving the documents is not at all having any merits.

4. Therefore, being satisfied with the reasons stated in the affidavit filed in support of this application, this application is allowed.

5. Registry is directed to receive the documents subject to proof and relevancy.

6.Post both the suits before the learned Additional Master IV on 17.03.2021 for recording evidence.
