S.Govindasamy v. Manoharan

C.M.P.Nos.5273 & 5274 of 2020 in S.A.No.425 of 2012 and S.A.No.929 of 2009 K.RAJASEKAR , J., Earlier, on 31.01.2024, this Court had referred the matters before Mediation (Mediation File No.93/2024) and Mediation Failure Report, dated 02.04.2024 has also been filed on the ground that the respondent No.1 was not interested and there was no appearance. It is reported that in S.A.No.929/2009, the appellant viz., Manoharan died and so far, no legal heirs have been impleaded. Further, in connected Second Appeal in S.A.No.425/2012, the legal heirs of the deceased appellant have been impleaded.

2. It is submitted by the learned counsel on both sides that all the parties have now appeared and ready to participate in mediation. Even though, in S.A.No.929/2009, the legal heirs of the deceased appellant have not been impleaded, but they may be sent for mediation and the parties are also present today.

3. Considering the above, both the Second Appeals are once again referred to the Mediation Centre. All the parties are directed to appear before the Mediation Centre of this Court on 10.09.2024 and the Mediation Centre is directed to engage a Mediator, who has earlier conducted the mediation, if possible.
