ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 318, 3(5) of BNS in Crime No.18 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused, received goods from the defacto complainant to the tune of Rs.17,00,00,000/-. It is alleged that after receiving the goods, the petitioner failed to make payment and thereby dishonestly cheated the defacto complainant. Hence, the complaint.

The learned counsel appearing for the petitioner submitted that the petitioner has not entered into any business transaction with the defacto complainant and that he has been falsely implicated in this case. He further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is involved in four previous cases of a similar nature. He further submitted that, upon detailed scrutiny, it was found that the petitioner has adopted this modus operandi to evade repayment and thereby swindled money from the defacto complainant as well as from other persons. Hence, he opposed to grant anticipatory bail to the petitioner.

Though from outside view, the allegations made against the petitioner non payment of money for the purchase made, on inner scrutiny shows that, these accused, targetted vulnerable suppliers and after gaining confidence by paying the money to small extent of properties and after receiving huge quantity with high value, they would abscond and similarly they have cheated several persons, this is the petitioner's modus operandi, hence this Court is not inclined to grant anticipatory bail to the petitioner.
