ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316, 318 r/w 315 of BNS in Crime No.12 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegations against the petitioner is that the petitioner is ranked as A2 in this case and he joining hands with A1, collected sarees worth about Rs.2.67crores from the defacto complainant and subsequently absconded, thereby cheated the defacto complainant, which led to the registration of an FIR. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is only the Salesman under A1 in this case and he was not involved in any offence. He further submitted that the petitioner is ready to cooperate with the investigation and hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and submitted that the modus of the petitioner is that he used to start a small unit and collected some garments and after gaining the confidence by making timely 2/4

repayment, they have collected huge value of sarees and closed the shop and cheat the suppliers. In this case, petitioner whose name is Krishnasamy @ Krishnamurthy was running a separate shop in the name and style of Sri Kalikambal silks, collected huge value of goods and this petitioner alone received the goods worth about Rs.95,00,000/- and subsequently cheated. He further submitted that the petitioner is having 3 similar cases. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature and gravity of offence, the fact that the petitioner is also having three previous cases of similar nature and also taking note of the fact that the petitioner was actively participated in the offence. Hence, I am not inclined to grant anticipatory bail to the petitioner.
