ORDER
(Order of the Court was made by the Acting Chief Justice) Mr.R.Vijayakumar, learned Additional Government Pleader takes notice for respondents 1 and 3 to 5, and Mr.A.N.Thambidurai, learned Special Government Pleader takes notice for the second respondent. Notice to respondents 6 and 7 is dispensed with.
2. The petitioner has filed this writ petition seeking issuance of a writ of Mandamus to direct the 1st respondent to take appropriate action based on petitioner's representation with regard to unauthorized construction and running of lodge and Gym at No.3, Lakshmi Avenue, Sri Ammbal Nagar, Senneerkuppam, Chennai-56 and pass appropriate orders.
3. The petitioner is the President of House Owners Welfare Association. It is the plea of the petitioner that even though the sixth respondent is the owner of the building and obtained permission for residential use, to the contrary the sixth respondent has leased the property to the seventh respondent, who is running a gym and a lodge in the said property. The petitioner sent representation on 6.8.2016 to the respondent authorities to take action with regard to unauthorized construction and running of lodge and gym by respondents 6 and
7. However, no action was taken based on the same. Hence, the present writ petition.
4. Considering the narrow scope of the prayer made in this writ petition, we direct the fifth respondent to consider the representation of the petitioner 6.8.2016 and do the needful in accordance with law at the earliest. The petitioner is directed to furnish a copy of the representation dated 6.8.2016 to the fifth respondent forthwith, if not already furnished.
