Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 420 of IPC, in Crime No.1416 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons had made a promise to the defacto complainant to arrange an amount of five crores as debt and thereby obtained a sum of Rs.20,00,000/- as commission. Thereafter, neither they arranged the amount nor tortured the said commission amount. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl. Side) raised objection stating that the petitioner had made a promise to the defacto complainant to arrange an amount of five crores as debt and thereby obtained a sum of Rs.20,00,000/- as commission. petitioner along with other accused persons taken the petitioner to Dharmapuri and told that the amount was inside the car dicky. Subsequently, they left the occurrence place with another car. Then the defacto complainant realized that he was cheated by them and the petitioner is the master mind for the above occurrence. Hence, he vehemently opposed for granting of anticipatory bail.
5. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering the gravity of offence committed by the petitioner, if he released on bail he may tamper the evidence and further there is no change of circumstances after the dismissal of the petitioner's earlier bail petition, this court is not inclined to grant bail to the petitioner. -sd/- 10/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
