ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.10.2025 for the alleged offences punishable under Sections 5(1), 5(n) r/w Section 6(1) of POCSO Act, in Crime No.16 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against the petitioner is that, this petitioner is a married man, and the victim girl aged about 13 years and the petitioner used to visit the home of the victim girl, taking advantage of her loneliness committed aggravated penetrative sexual assault and it was done for a long period and on 24.08.2025 it was reported to the family. Hence, this case.

3. Earlier, this Court dismissed the bail petition in Crl.OP.No.34932 of 2025 dated 19.12.2025 on the following reasons: "6. Considering the facts and circumstances of this case, I have also gone through the statement of the victim girl under Section 183 of BNSS Act, it revealed that various the facts that the petitioner herein had continuously involved in aggravated penetrative sexual assault, hence this Court is not inclined to grant bail to the petitioner at this stage."

4. Since there is no change in circumstances to revisit the earlier order, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 12.02.2026 drl 2/4
