PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to provide educational loan Rs.9,80,440/- to the petitioner.

O R D E R

The relief sought for in the present writ petition is to direct the respondents to provide educational loan Rs.9,80,440/- to the petitioner.

2. The petitioner was admitted to undergo B.D.S Course at Annamalai University at Chidambaram. The petitioner states that she paid first year fees by mortgaging the jewels belongs to her mother. However, she could not able to pay the University fees for other consecutive years. Hence, the petitioner borrowed loan from outside.

3. The learned counsel for the petitioner states that the petitioner completed the course and she has not yet paid the fees and therefore, unable to collect the certificates.

4. The fact remains that the petitioner applied for the educational loan in the year 2015 and now completed the course. Therefore, under the scheme, whether the petitioner is eligible at this length of time itself is questionable. https://hcservices.ecourts.gov.in/hcservices/

5. The learned counsel for the respondents states that during the relevant point of time, the application submitted by the petitioner was considered and the loan was not sanctioned. However, this Court cannot go into those disputes at this length of time. But the petitioner is at liberty to approach the Bank for suitable loan under any eligible scheme, if she is otherwise eligible. In the event of submitting any such application for loan, the respondent Bank shall consider the same on merits and in accordance with law.

6. With this liberty, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
