ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.01.2026, for the offences punishable under Section 123 of BNS, in Crime No.55 of 2026, registered on the file of the respondent police, seeks bail. 1/4
2. The case of the prosecution is that the petitioner herein joined hands with the other accused involved in selling of Tapentadol tablets for the purpose of intoxication. This tablet was sold to the defacto complainant and he consumed by mixing it in glucose water and drank it; after consuming it, the complainant became unconscious and hence, a case has been registered against the petitioner herein.

The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and submitted that there is no previous case as against the petitioner; he was in judicial custody from 25.01.2026 and is in custody and the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner herein was found with possession of 100 numbers of tablets and further, he is also having five previous cases and that the further investigation of this case is pending. 2/4

I have also gone through FIR and other connected records in this case. Considering the facts and circumstances of the case and the fact that the petitioner is having five previous cases, I am not inclined to grant bail to the petitioner herein.
