Prayer: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of a Writ of mandamus to direct the second respondent to consider the claims of the petitioner and pass orders on the proposal of the fourth respondent dated 3/10/2023 which was forwarded by the third respondent dated 24/11/2023 to the second respondent with regard to brought into regular time scale of pay of the petitioner in the post of Sanitary Worker by considering the petitioner's representation dated 12/11/2025. ORDER
The petitioner has filed the present writ petition seeking a direction to the respondents to bring her into regular time scale of pay in the post of Sanitary Worker, based on the proposal of the 4th respondent dated 03.10.2023 and the recommendation of the 3rd respondent dated 24.11.2023, and consequently to disburse arrears.

2. It is the case of the petitioner that her husband was appointed as Sanitary Worker on consolidated pay on 30.06.1999 and his appointment was ratified on 11.10.2001. He died on 28.11.2002, leaving the petitioner and two daughters. The petitioner applied for compassionate appointment, but her request was kept pending. On earlier litigation in W.P.No.31074 of 2015, this Court, vide order dated 01.10.2015 directed the respondents therein to consider the petitioner's claim. Thereafter, the 4th respondent vide proceedings dated 21.06.2016 negatived the petitioner's claim. Though the claim was initially rejected on 21.06.2016, this Court allowed W.P.No.32507 of 2018 on 18.12.2018 directing the 1st respondent therein to grant compassionate appointment. Aggrieved by the said order, the respondents preferred an appeal viz., W.A. No.
4183 of 2019 and this Court vide order dated 02.12.2019 modified the same and directed to grant compassionate appointment as per the relevant Government Order. Pursuant thereto, the petitioner was appointed on 27.05.2020 as Sanitary Worker on consolidated pay, with a stipulation that she would be brought under regular time scale of pay on completion of three years.
3. It is the grievance of the petitioner that though the 4th respondent sent a proposal dated 03.10.2023 and the 3rd respondent recommended the Page No. 3 of 7
same on 24.11.2023, and despite representations dated 22.03.2024 and 12.11.2025, no orders have been passed. Hence, the present Writ Petition.

Learned counsel for the petitioner submitted that the petitioner is legally entitled to be brought under regular time scale of pay upon completion of three years of service, in view of the Government Orders and the condition stipulated in the appointment order dated 27.05.2020. He argued further that delay in granting regular time scale is arbitrary and contrary to the earlier orders passed by this Court. Hence, it would suffice, if a suitable direction is issued by this Court in the above regard.

Per contra, learned Additional Government Pleader appearing for the respondents 1 to 5 submitted that the proposal sent by the 4th respondent is under consideration and necessary approval from the 1st respondent is required before extending the benefit of regular time scale of pay. However, appropriate orders would be passed subject to administrative approval and this Court may issue directions, accordingly.
6. In view of the aforesaid submissions, without going into the merits of the case, there shall be a direction to the 2nd respondent to consider the Page No. 4 of 7
petitioner's representation dated 12.11.2025, in the light of the proposal dated 03.10.2023 submitted by the 4th respondent and the recommendation dated 24.11.2023 made by the 3rd respondent, in line with the directions issued by this Court on 02.12.2019 in W.A. No.4183 of 2019 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. If the petitioner is found eligible, consequential benefits including fixation in regular time scale of pay and admissible arrears shall also be considered and disbursed in accordance with law.
7. With the above directions, this writ petition stands disposed of. No costs.
