ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.12.2025, for the alleged offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3), 109 of BNS, 2023 in Crime No.276 of 2025 on the file of the respondent police seeks bail.
2. The allegation against the petitioner is that he is arrayed as A1 in this case. It is alleged that due to previous enmity, the petitioner joined hands with other accused attacked the defacto complainant and two other persons, including his son, with wooden log indiscriminately, causing multiple injuries. It is further alleged that one of the injured namely Chandru, sustained grievous injuries resulting in permanent loss of vision in one eye. Hence, a case was registered and the petitioner was arrested.
3.The earlier bail application of the petitioner was dismissed by this Court, vide order dated 09.01.2026 in Crl.O.P.No.572 of 2026 for the following reasons:
"6. Considering the nature of the allegations, the fact that one of the injured has suffered permanent loss of vision, and that the petitioner has one previous case pending against him and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed."
4.The learned counsel for the petitioner submitted that the petitioner is ranked as A1 in this case and the co-accused/A2, A3 and A4 have already been granted bail by this Court in Crl.OP No.35444 of 2025 dated 30.01.2026 and in Crl OP No.35651 of 2025 dated 12.01.2026 respectively. Hence, he prayed for the grant of bail to the petitioner.
5.Considering the facts and circumstances of the case and the co-accused/ A2, A3 and A4 have already been granted bail by this Court, this Court is inclined to grant bail to the petitioner with certain conditions. 6.
Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Kallakurichi and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the learned Judicial Magistrate No.I, Kallakurichi, everyday at 10:30 a.m.,
for a period of two weeks and thereafter, appear before the respondent police as and when required for interrogation; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
