Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records of the 1st Respondent pertaining to his proceedings Na.Ka.No.670/Aa1/2020 dated 05.10.2020 and quash the same.

ORDER

The District Registrar herein has issued a notice to the petitioner dated 05.10.2020 in connection with an enquiry under Section 82 r/w 83 of the Registration Act. This notice is under challenge.

2.The learned counsel for the petitioner brought to the notice of the Court an earlier proceedings of the District Registrar/first respondent dated 01.07.2015, wherein, he had indicated that the issue raised can only be resolved before the civil Court.

3.Heard, Mr.T.M.Pappiah, learned Special Government Pleader for the first respondent.

4.It may be that the present enquiry may well be a process at the instance of some third parties, however, inasmuch as the Statutory Authority seeks the participation of the petitioner to assist him to resolve the controversy before him, it is only appropriate the petitioner comply with such request of the Statutory Authority.

5.The District Registrar/first respondent is now required to issue a fresh notice fixing the date of enquiry and may give a full and effective hearing to the petitioner and decide the matter strictly in accordance with law within a period of 8 weeks from the date of enquiry.

6.The Writ Petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
