..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, to direct the Respondents 1 to 3 to consider petitioner's representation dated 11.09.2025 and consequently, direct the Respondents to take appropriate action as against the 4th Respondent for

deliberately flouting the rules which is in clear violation of the Tamil Nadu Combined Development and Building Rules, 2019 (TNCDBR). For Petitioner(s):

O R D E R

This Writ Petition has been filed to direct the official respondents to take appropriate action against the 4th respondent for the alleged violation of the building sanctioned by the 4th respondent in putting up the construction in his property.

2.According to the petitioner, without leaving the required setback as per the approved plan, the 4th respondent is constructing the building in his property. The petitioner is the neighbouring property owner. The petitioner had given a representation on 11.09.2025 to the official respondents, requesting them to take action against the 4th respondent for the building plan violation committed by him. Since the same was not considered, the petitioner has filed this Writ Petition.

3.Ms.C.Meera Arumugam, learned Additional Government Pleader, accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed as against the 4th respondent, notice to the 4th respondent is dispensed with by this Court.

4.No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the 4th respondent, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

5.For the foregoing reasons, this Writ Petition is disposed of by directing the 3rd respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 11.09.2025, seeking for taking action against the 4th respondent for the alleged building plan violation committed by him while constructing the building in the 4th respondent's property, after hearing the objections of the 4th respondent, within a period of twelve weeks from the date of receipt of a copy of this order.
