This application has been filed seeking to condone the delay of 275 days in filing the written statement of the third defendant and in filing adoption memo by the first and second defendants.

2. In the affidavit filed in support of the application, it had been stated that the litigations have been taken up in Appeal before the Hon'ble Supreme Court and finally, an order had been passed on 19.01.2024 and the Supreme Court had granted three weeks' time to file the written statement. It had been stated that owing to various litigations, the written statement may not be filed.

4. The learned counsel for the plaintiff questioned the authority of the first defendant in filing the written statement and questioned the locus of the third defendant to be represented by the first defendant.

5. However taking into consideration the reasons advanced, the delay of 275 days is condoned. This Application stands allowed.

6. List the matter under the caption 'for framing issues' on 18.07.2024.
