4. Minor Miruthula R3 and R4 represented by a guardian Mr.P.Shyamchander .. Respondents This case is taken up for settlement before the Lok Adalat. Both the parties are present. The learned counsel for the appellant Mr.P.Dinesh Kumar, for Mr.T.Chandrasekaran, learned counsel for hte petitioner on record and the learned counsel for the respondents Mr.K.Premkumar are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.1,20,02,500/- with interest
at 7.5% per annum and costs, from the date of petition, till the date of realisation. Challenging the quantum of compensation, the appellant / Transport Corporation had preferred the present appeal.
2. After due deliberation and consultation, both the parties have agreed to settle the claim for a sum of Rs.1,50,00,000/- (Rupees One Crore Fifty Lakhs only) in full quit.
3. The appellant/ Transport Corporation is directed to deposit the modified award amount Rs.1,50,00,000/- in full quit, less the amount of Rs.25,000/- which was already deposited to the credit of MCOP.No.1406 of 2021 before the Motor Vehicles Accident Claims Tribunal, (Chief Judge, Court of Small Causes) at Chennai, in six installments. It is made clear that the first installment shall be made within a period of eight weeks from the date of receipt of a copy of this order and the balance award amount shall be paid at the rate of Rs.25,00,000/- in remaining five installments, in every fifteen days without default . The shares of the claimants can be deposited as per the apportionment fixed by the Tribunal.
4. On such deposit being made, the Tribunal is directed to transfer the above said award amount to the Bank account of the respondents / claimants (majors) by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition. The share of the minor
claimants 3 and 4 shall be deposited in any one of the nationalised banks till they attain majority. Mr.Shyam Chander is permitted to withdraw the already accrued interest of the minors shares and also once in three months from the Bank directly for the benefit of the minors.
5. The award is modified accordingly and the Civil Miscellaneous Appeal is disposed of. Consequently, connected miscellaneous petition is closed.
