Mrs.Selvi Venkatasubramani ... Respondent Civil Revision Petition filed under Article 227 of Constitution of India against the judgment and decree dated 13.11.2024 passed in RLTA No.147 of 2023 on the file of XVII Additional City Civil Court, Chennai by confirming the order and decretal order dated 26.04.2023 made in RLTOP No.792 of 2022 on the file of XVI Judge, Small Causes Court, Chennai. ORDER
The learned counsel for the petitioner circulated a letter to the Registry seeking permission of this Court to withdraw the civil revision petition and has also made an endorsement in the memorandum of grounds of revision to the same effect. However, the learned counsel for the respondent would state 1/3
that possession has been taken through Court process and the landlord is yet to recover the arrears amount. The learned counsel for respondent, therefore, opposes withdrawal since the tenant may put this against the landlord when the landlord initiates proceedings for recovery of arrears of rent. The withdrawal of the revision shall not come in the way of the respondent working out his legitimate rights.
2. With the above observation, the civil revision petition is dismissed as withdrawn. Consequently, the connected civil revision petition is closed. There shall be no order as to costs.
