ORDER

The present Criminal Original Petition has been filed to call for the records in C.C. No.295/2016 on the file of the learned Judicial Magistrate, Mettupalayam, and quash the same.

2. When the matter is taken up for hearing, learned counsel appearing for the petitioner prays to issue a direction to the petitioner to raise all the issues before the trial Court and to dispose of the case pending on its file within a reasonable time.

3. Learned Government Advocate (Crl. side), appearing for the respondent police, has no objection to this Court acceding to the said request and submits that such a direction may be issued to the trial court.

4. In such view of the matter, this Court is of the considered opinion that without going into the merits of the case, it would be suffice to issue a direction to the trial court to complete the trial in C.C. No.295/2016 as expeditiously as possible, more particularly, within a period of six months from the date of receipt of a copy of this order. Further, taking into consideration the request as made by the learned counsel for the petitioner, his appearance before the trial court is dispensed with except for his appearance for the purpose of receiving the copy of the proceedings u/s 207 Cr.P.C., framing of charges, questioning under Section 313 Cr.P.C. and on the day on which judgment is to be pronounced. However, if for any particular reason, the presence of the petitioner is necessary, the trial court, at its wisdom, shall direct their appearance on those days.
