2016-06-09Honourable Mr Justice S. Vaidyanathan2 pages

CRL.OP.No.11740 of 2016 S.VAIDYANATHAN, J.

The petitioner, apprehends arrest at the hands of the respondent police for alleged offences punishable under Section 4(1)aaa and 4(1) AAA of T.N. Prohibition Act of IPC in Crime No.225 of 2016 on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is found in possession of 264 Quarter bottles without any licence and hence, a case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl.side) strongly opposed to grant anticipatory bail stating that already the petitioner has three previous cases which are similar in nature.

5. Considering the fact that the offence alleged against the petitioner is grave in nature and he has involved in three previous cases to his credit, I do not find any change of circumstances to consider this petition. Accordingly, this Criminal Original Petition is dismissed.
