ORDER

This petition has been filed to cancel the anticipatory bail granted to the 2nd respondent herein by order dated 12.12.2025 in Crl.O.P.No.34091 of 2025. 1/4

The learned counsel for the petitioner would submit that, while filing anticipatory bail petition before this Court, he also filed petition before the learned Principal Sessions Judge, Vellore seeking same relief and the same was pending, however, suppressing the said fact, he obtained anticipatory bail on 12.12.2025 in Crl.O.P.No.34091 of 2025.

Per contra, the learned counsel for the 2nd respondent objected the above contention and submitted that, pendency of the anticipatory bail petition pending before the learned Principal Sessions Judge, Vellore, the same was not filed on instructions from the 2nd respondent and in this regard, he had lodged a complaint before the Bar Council against Advocate Madan and also submitted the copy of the complaint, wherein there is a seal of the Bar Council of Tamil Nadu.

4. In such view of the peculiar circumstances of the case and upon the fact that the application filed before the learned Principal Sessions Judge, Vellore was without the knowledge of the 2nd respondent, this Court finds no ground to cancel the anticipatory bail granted to the 2nd respondent. 2/4
