PRAYER Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified mandamus calling for the records relating to the order passed by the Presiding Officer, Labour Court, Kumbakonam in I.D.No.30/2018 dated 14.11.2018 and quash the same and further to direct the respondents 1 to 3 to reinstate the petitioner in service with all back wages and monetary benefits. ORDER

This Petition has been filed seeking to quash the award dated 14.11.2018 passed by the Presiding Officer, Labour Court, Kumbakonam in I.D.No.30 of 2018

2. Seeking to reinstate the petitioner with full back wages, continuity of service and all other attendant benefits, he raised an industrial dispute u/s.2A(2) of the Industrial Dispute Act, 1947 before the Labour Court and the Labour Court vide order dated 03.10.2014, has directed the management to pay lumpsum compensation of Rs.1,00,000/- to the petitioner / workman in lieu of reinstatement. Challenging the same, the present writ petition has been filed by the petitioner / workman.

3. When the matter is taken up for hearing learned counsel for the petitioner / workman and the learned counsel for the respondents 1 to 3 submitted that during the pendency of this writ petition the matter was amicably settled between the parties and that the respondents 1 to 3 are ready to pay a sum of Rs.2,00,000/- in full quit as compensation to the petitioner within the time frame that may be fixed by this Court.

4. In view of the fair submission made by the learned counsel for the respondents 1 to 3, this Court directs the respondents 1 to 3 / management to pay a sum of Rs.2,00,000/- as full quit to the petitioner within a period of two

(2) weeks from the date of receipt of a copy of this order.

5. With the above direction and observation, this writ petition is disposed of. No costs.
