Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 3 to remove the encroachment/debris made by the respondents 4 to 7 in the land situated at Survey Nos.126/3 and 128/1 situating in Irulpatti Village, Papirettipatty Circle, Dharmapuri District and to restore and maintain the irrigation channel running through above land by considering the petitioners representations dated 6.11.2023 and 1.01.2024.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.J.Kishore, learned counsel for the petitioner, Mr.C.Kathiravan, learned Special Government Pleader for respondents 1 and 2 and Mr.A.Edwin Prabhakar, learned State Government Pleader for respondent 3.

2. The learned Special Government Pleader, on instructions, submits that steps are being undertaken for removal of the debris/encroachment in S.Nos.126/3 and 128/1. The final survey has been directed to be conducted within a period of two months and depending upon the survey report, further steps, in accordance with law, would be undertaken for removal of the debris/encroachment.

3. In view of the said statement, the writ petition stands disposed of. There shall be no order as to costs. (S.V.G., CJ.) (D.B.C., J.) 23.02.2024 Index :
