ORDER

Heard the learned counsel appearing for the parties.

2. The petitioner is the wife in a matrimonial proceeding. She sought for transfer of DVC.No.91 of 2020 from the file of the Judicial Magistrate Court, Puducherry, to the file of the Judicial Magistrate Court, Neyveli.

3. The learned counsel for the petitioner would invite my attention to the orders passed by this Court on 25.03.2025 in Tr.C.M.P.No.189 of 2025 wherein at the instance of the petitioner herein, HMOP No.615 of 2020 was 1/4

withdrawn from the Family Court, Pondicherry and transferred to the file of Sub Court, Neyveli. The said order was passed taking into consideration the request made by the petitioner alone, even without appearance of the respondent.

The learned counsel for the respondent would submit that since HMOP No.615 of 2020 has been transferred to the Sub Court, Neyveli, the respondent has no serious objection for transferring DVC proceedings from the file of the Judicial Magistrate Court, Puducherry, to the file of the Judicial Magistrate Court, Neyveli.

5. In the light of the same, this Transfer Civil Miscellaneous Petition is allowed. The case in DVC.No.91 of 2020 is hereby withdrawn from the file of the Judicial Magistrate Court, Puducherry and transferred to the file of the Judicial Magistrate Court, Neyveli. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed. 13.06.2025 vum Index : Yes/No Speaking Order : Yes / No To
